Privacy Policy
Rules for processing personal data on this website.
1. Definitions
- Controller or Netia – Netia S.A., ul. Poleczki 13, 02-822 Warsaw, Poland
- Personal data – any information relating to an identified or identifiable natural person through one or more specific factors determining physical, physiological, genetic, mental, economic, cultural or social identity, including (where it allows identification of the User) device IP address, location data, online identifiers and information collected via cookies and other similar technologies.
- Privacy Policy – this Privacy Policy.
- GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
- Service – the website operated by the Controller or an entity acting on behalf of the Controller (Authorised Partner) at: www.uslugi-netia.pl
- User – any natural person visiting the Service or using one or more services or functionalities of the Service.
2. Processing of data in connection with the use of the Service
- This Privacy Policy describes the rules for using cookies or other similar technologies and the rules for processing personal data collected during the User's use of the Service.
- In connection with the User's use of the Service, the Controller collects their data to the extent necessary to provide the individual services offered, as well as information about the User's activity on the Service, including device IP address, location data, online identifiers and information collected via cookies and other similar technologies. Cookies and similar technologies are not used to identify the User and the User's identity is not established on their basis. Cookies and similar technologies, when they do not independently allow identification of a natural person, only in combination with other unique identifiers or other information allowing identification of that natural person, may constitute personal data.
- Use of the Service is possible without the need for the User to create an account. In such a case, use of the Service does not require providing personal data in a registration form. Processed data includes information about the use of the Service.
3. Cookies and similar technologies
- In connection with the use of the Service, cookies or similar technologies are used to provide the User with access to the Service and improve its operation.
- Cookies are small text files stored on the User's telecommunications terminal device (computer, phone, tablet, etc.) while using the Service, allowing the storage and reading of information that the Controller and other entities providing services on its behalf (e.g. analytical and statistical) use for various purposes, which can be divided into the categories described below.
- Technologies similar to cookies include, among others, local storage, session storage, and service workers, which work as follows: technology using a dedicated part of browser memory for storing data saved by the website.
- For simplicity, cookies and similar technologies will hereinafter be referred to collectively as "cookies".
- We use two types of cookies or similar technologies, based on their lifetime:
- session – files stored on the User's device until the session ends;
- persistent – files stored on the User's device until deleted by the User or until the cookie expires as specified in the cookie specification.
- The Controller and other entities providing services on its behalf (e.g. analytical and statistical) use cookies for various purposes, which can be divided into the following categories.
- Required cookies, essential for using the Service:
- cookies with data entered by the User (session identifier) for the duration of the session (user input cookies);
- authentication cookies used for services requiring authentication for the duration of the session (authentication cookies);
- cookies used to ensure security, e.g. used to detect authentication abuse (user centric security cookies);
- session cookies for multimedia players (e.g. flash player cookies), for the duration of the session (multimedia player session cookies);
- Functional cookies, facilitating the use of the Service:
- persistent cookies used to personalise the User's interface for the duration of the session or slightly longer (user interface customization cookies),
- cookies used to monitor website traffic, i.e. data analytics – these are files used to analyse how the User uses the Service, to create statistics and reports on the functioning of the Service.
- Required cookies, essential for using the Service:
- The User may change the cookie or similar technology settings at any time by changing privacy settings in the browser or application, provided that this change may result in lack of access to some Service features.
- Changing privacy settings is possible by selecting the appropriate option in the browser or application settings. In the case of the most popular web browsers, the User can independently manage privacy settings, including cookies, in particular by accepting cookies, changing cookie settings and blocking or deleting cookies. The method and scope of privacy settings changes depends on the type or version of the browser or application used by the User. Detailed information on changing privacy settings is available on the websites of these providers.
4. Purposes and legal bases for data processing in the Service
The Controller processes Users' personal data for the purpose of:
- providing access to the Service – based on Art. 6(1)(b) GDPR;
- performing obligations arising from legal provisions – based on Art. 6(1)(c) GDPR;
- pursuing the following legitimate interests of the Controller or a third party – based on Art. 6(1)(f) GDPR:
- detecting and eliminating abuse;
- internal purposes related to the provision of services and conducting business activities, including evidentiary, analytical and statistical purposes.
5. Personal data retention period
Personal data will be processed for a period:
- provided for the fulfilment of obligations arising from legal provisions concerning defence, state security and public safety and order, as well as tax and accounting provisions,
- for the limitation period of claims and until the completion of civil, enforcement, administrative and criminal proceedings requiring data processing, and in the case of consent until the purpose of consent is achieved or it is withdrawn, whichever occurs first.
The User may independently delete cookies from their device. To clear the User's terminal device (computer, phone, tablet, etc.) of cookies, the browser cache and cookies should be deleted. The process of clearing the cache and cookies should be performed in the browser settings. Settings may vary depending on the browser and its version. More information on the options available in individual browsers can be found in section 3.8. Deleting cookies will result in the deletion of Service settings.
6. User rights
The User may file a complaint regarding the processing of personal data to the supervisory authority dealing with the protection of personal data. In the Republic of Poland, the supervisory authority is the President of the Personal Data Protection Office.
7. Data recipients
Users' personal data may be transferred to the following categories of recipients: entities providing the Controller with services necessary for the achievement of processing purposes, including IT providers, entities providing technical, organisational and advisory support, other subcontractors in the field of customer service, integrators and entities authorised under legal provisions, companies of the Polsat Plus Group.
8. Transfer of data outside the EEA
The User's personal data may be transferred to countries/international organisations outside the European Economic Area when these countries/organisations have been recognised by the European Commission as providing an adequate level of personal data protection to the level of protection applicable in the European Economic Area, or subject to the application of appropriate safeguards, which may consist of the use of binding corporate rules, standard data protection clauses adopted by the European Commission, standard data protection clauses adopted by the President of the Personal Data Protection Office or contractual clauses approved by the President of the Personal Data Protection Office, and copies thereof may be obtained upon request submitted as indicated in section 10 below.
9. Personal data security
- The Controller continuously conducts risk analysis to ensure that personal data is processed by it in a secure manner – ensuring above all that only authorised persons have access to the data and only to the extent necessary due to the tasks they perform. The Controller ensures that operations on personal data are recorded and performed only by authorised employees and associates.
- The Controller takes all necessary actions to ensure that its subcontractors and other cooperating entities also guarantee the application of appropriate security measures whenever they process personal data on behalf of the Controller.
- We have implemented solutions in the Service that ensure a high level of protection of your personal data.
10. Contact details
- Requests, declarations and all correspondence regarding personal data should be directed by phone to the Customer Service Department (tel. 801802803, 227111111 or mobile 793800300), in writing to the address: Netia S.A. – Complaints Department, P.O. Box 597, 40-950 Katowice S105, if you are our customer electronically via the form on the Netia Online website, as well as in writing or orally to the protocol at the Point of Sale (service).
- The Controller has appointed a data protection officer who can be contacted: electronically at iod@netia.pl or in writing to the above address of the Controller's registered office with the note "Data Protection Officer".
11. Changes to the Privacy Policy
The Privacy Policy is regularly reviewed and updated as necessary. The current version of the Privacy Policy was adopted and has been in force since 05-02-2021.
